In the blogging, social networking, open information age, unflattering pictures of people pop up right and left. But would like to sue someone for just posting an image? Or even more, sue Google for denying taking it down?
That is exactly what minority owner of the Miami Heat NBA Team Ranaan Katz has confirmed to do. According to paidContent, Katz has based his statement on copyright violation but also wrote in complaining that the picture is partially distorted because of unflattering nature.
The image in question presents Katz standing courtside during a basketball game with his eyebrows raised, chin put away and tongue hanging to the side. No doubt, it is not very flattering. The complaint Katz filed in Miami federal court requests for the damages payment by both the blogger who posted the image and Google for not taking it down, as stated by the PaidContent.
The blogger that posted the image operate a blog called RK Associates, which is dedicated to disclose Katz for allegedly shady commercial real estate operations and other improper behavior. This is not the first occasion when their paths have crossed. Katz sued the blogger one year ago in defamation lawsuit in respect to critical blog posts, as revealed by paidContent.
For its part, Google involved at the time when Katz served a Digital Millennium copyright Act notice to the search out giant with a request to eliminate the image. Google gets millions of such requests in every month and says that it grants 97 % of them. Apparently photo of Katz didn’t quite make that cut.
